Pre-enactment Advocacy of the Legislative for the Amendment of the Explosives Act, Cap.298

The Uganda Law Reform Commission is undertaking pre-enactment for the proposals for the amendment of the Explosives Act, Cap. 298. In 2017, the Commission undertook a review of the Explosives Act, Cap. 298 with a view to aligning the law with the prevailing circumstances. The study report and legislative proposals were submitted to the Ministry of Justice and Constitutional Affairs and the Ministry of Internal Affairs for further implementation.

The legislative proposals provide for:

  1. the repeal and replacement of Explosives Act, Cap 298;
  2. restrictions and prohibition of manufacture, use, storage, transportation and dealing in explosives without a license or permit;
  3. restriction of manufacture of explosives to government or persons who have partnered with government;
  4. the establishment of Explosives Committee to over see the use of explosives;
  5. the establishment of the office of the chief explosives officer to issue permits and supervise the use of explosives;
  6. prohibition of blasting explosives without a permit;
  7. restrictions on the export and import of explosives;
  8. restrictions on the establishment of explosives factory or magazines;
  9. punitive offenders and penalties for misuse of explosives;
  10. the duty of care and precautions during the use of explosives; and
  11. exemptions to certain categories of explosives that may be used for example in research and education.

The Commission is undertaking pre-enactment advocacy on the proposed legislative proposals for the amendment of the Explosives Act, Cap 298 with key stakeholders. The advocacy, is intended to:

  1. create awareness of the legislative proposals;
  2. validate legislative proposals with stakeholders;
  3. build consensus on the legislative proposals and other relevant action points; and
  4. ensure that stakeholders are involved in the law reform process from an informed point of view.

The Explosives (Amendment) Bill, 2023 has been prepared and submitted to Cabinet for approval.
